Job Summary:
1.COORDINATE LEGAL, TAXATION, STATUTORY AND GENERAL INTERFACES WITHIN AND BETWEEN THE EPPF AND ITS STAKEHOLDERS:

•Investigate matters by gathering all relevant documentation and drafting proposals, on request by Head: Legal and Corporate Secretariat, assuring compliance to legislation.

•Review and interpret current EPPF Rules, monitoring that legal administration accurate and accessible.

•Draft new EPPF Rules, in compliance with relevant legislation, responding to needs identified.

•Obtain formal legal advice from external sources when required.

•On request, compile specific ad-hoc reports and recommendations.

•Ensure receipt of summonses and court related documents served on the EPPF.

•Investigate and compile a report outlining action plans related to summonses and court orders.

•Draft initial standard documentation for authorisation by Manager e.g. acknowledgement of debt, rules and contracts.

•Resolve disputes by liaising with external parties verbally and in writing e.g. member complaints.

2.PROVIDE ASSISTANCE IN THE ADMINISTRATION OF THE EPPF RULES:

•Maintain a library of documents related to rules and benefits, enabling knowledge sharing.

•Update the rule book and provide members and pensioners with any changes in order to achieve a consistent legal service.

•Establish and maintain a database of all internal opinions, contracts and other precedents.

•Share legal knowledge and experience with relevant internal stakeholders.

3.PROVIDE LEGAL OPINION AND ADVICE (MAINLY ON RETIREMENT FUND ISSUES):

•Investigate facts surrounding advice request and scrutinises relevant legal documents in order to provide expert legal advice which informs business decisions.

•Research legal principles and apply same to facts to protect organisational interests.

•Formulate and communicate legal opinion, relating factual information to support decisions.

•Submit reports to Manager, identifying and recommending ways to mitigate legal risks.

•Participate in various Fund Committees and provide legal advice in such Committees.

4.PROVIDE LEGAL ASSISTANCE FOR ADJUDICATION OF COMPLAINTS AGAINST FUND AND GENERAL LITIGATION:

•Conduct an investigation of relevant circumstances to ensure an accurate factual basis is established on designated issues.

•Research applicable legal principles and Pension Fund Rules and apply to facts to establish a legal position.

•Manage resources and litigation process, protecting the EPPF’s interests and minimising costs.

•Represent EPPF at statutory inquiries, administrative or any other proceedings as and when required.

•Managing the Fund’s panel of attorneys to ensure that the terms of SLAs are adhered to.

•Receive and conduct an initial evaluation of court processes served on the Fund and advise on approach to be adopted by the Fund to address such processes.

•Instruct panel attorneys on matters referred to them.

•Manage the process of litigation and provide necessary support to external legal service providers.

5.MANAGE CONTRACTS:

•Draft agreements to protect the interests of the Fund, in compliance with associated laws.

•Review agreements and provide legal advice to the Fund on the implications of contracts, minimising legal risk.

•Make alterations and/or negotiate alterations to contracts to protect the interests of the Fund.

•Resolve contractual disputes in the interests of the Fund.

•Deal with contract exit management appropriately, minimising risk.

•Maintain a repository and database of all Fund contracts which are signed and accessible.

6.MANAGE REGULATORY UPDATES:

•Draft regulatory updates to Management and relevant Board structures; as required.

•Conduct regulatory development awareness in the Fund to transfer knowledge.

Requirements:
•Relevant Bachelor Degree and preferably a tertiary qualification such as ILPA, CFP,

•At least 5 years job-related experience (at a Pension Fund or similar environment), which should include at least 2 years’ experience in a management role (where relevant).

•Working knowledge of EPPF Rules and Regulations. Pension Fund Act and Regulations associated circulars issued by Registrar.

•Working knowledge of Retirement Fund Law.

•Working knowledge of Income Tax Act.

•Working knowledge of Labour Relations Act.

•Working knowledge of Divorce Act.

•Microsoft Office.

•Report writing.

•Stakeholder Management.

•Effective Communication (written and verbal).

•Impact & Influence.
