The Legal Services Unit renders legal and compliance services to all units of the HSRC and ensures that legal matters are managed in an effective and efficient manner within the organisation by vetting and reviewing contracts; coordinating referrals to a panel of attorneys; ensure compliance; commenting on labour relations matters, and dealing with IP and copy right matters.

 

 

 

Job Title: Legal and Compliance Advisor
Location: Pretoria, Gauteng, South Africa

Job Summary:
The successful incumbent will be based in Pretoria and will be required to travel to the other HSRC offices as and when the need arises.

Key responsibilities:

•Ensuring that an effective and efficient legal service is rendered to the organisation;
•Conduct legal research and prepare legal opinions on various legal matters;
•Drafting, analysing and reviewing contracts and other legal documents for the HSRC. These include agreements for the HSRC both to undertake funded research and to buy- in services;
•Participating in negotiations with both clients and service providers on contractual terms and conditions of agreements;
•Knowledge of contract law, conflicts of laws and international instruments dealing with sale of goods and services.
•Ensure adequate internal controls are in place to meet compliance with all required laws, rules, and regulations.
•Assist all Board, Board Committees and Management with the interpretation of legislation to ensure that the HSRC acts within the confines and parameters of applicable legislation.
•Serve as a legal and compliance resource and point of reference on legal and compliance matters, as well as rendering formal and informal legal opinions on various commercial matters and providing legal comments on various documents;
•Provide overall legal and compliance advice to the HSRC leadership and Management to ensure compliance with legislation, regulations, policies and procedures;
•Identify the principal risks of the legal environment and implement appropriate systems to manage these risks;
•Conduct legal due diligence to identify and minimize potential legal risks;
•Establish a compliance and reporting framework;
•Draw up a framework compliance universe;
•Monitor HSRC compliance on a continues basis;
•Report on compliance related matters to senior management and ARC.

Education And Experience Requirements:

•A recognised Legal Degree. A minimum of three years’ post article experience, or experience as an in-house legal advisor / compliance officer.
• Qualification in Compliance management is preferable;
•Ability to work under pressure and to deadlines;
•Excellent written and verbal communication skills and analytical problem-solving skills;
•Credibility to interface with management, researchers and support staff;
•Demonstrate initiative, integrity and maturity;
•Experience in drafting and vetting of Contracts;
• Undertake legal research and legal studies to keep abreast of new development in legal field and case law;
•Advise the HSRC accordingly on legislative changes/reforms and make proposals/recommendations on Law reform.
•Knowledge of the PFMA and its application.
