To provide Legal services for SACAA with emphasis on Enforcement and Exemption matters.
Ensure that SACAA enforce regulatory compliance by enforcing compliance to the Civil Aviation Act, Civil Aviation Regulations and South African Civil Aviation Technical Standards.
Ensure that cases of non-compliance are investigated and determining an appropriate sanction or penalty thereto. Participate in the development of Regulations and Technical Standards. Ensure that SACAA is protected against any legal risk when taking the necessary enforcement actions.

Job Summary:
Research and draft accurate and legally correct legal opinions.
Recommend the course of action to be taken.

Litigation Process:
Consider the merits of the matter.
Research the legalities pertaining to the matter and ensure that SACAA is protected against any legal risk that may arise.
Coordinate, provide assistance to, monitor and guide the attorneys in litigation matters.
Monitor and manage appeals lodged at the Civil Aviation Appeal Committee.

Enforcement and exemptions:
Develop and comment on policy guidelines for enforcement.
Develop training material and conduct training.
Provide legal advice and guidance on enforcement actions to be taken and make recommendations.
Convene and play an instrumental role in Enforcement Meetings.
Consult with relevant law enforcement agencies.
Manage and monitor the exemptions register and ensure consistency in the decisions taken on exemptions. Perform any other function for Legal Department when delegated by the Senior Manager: Legal and Aviation Compliance.
Provide any legal advice when assigned to do so.

Drafting of Contracts:

Draft, vet, interpret and advise on contracts to ensure compliance and to protect the interests of SACAA.

Regulation Development:
Draft/vet proposals for amendment of regulations and technical standards.
Facilitate and monitor the approval process of the regulations, ensuring that the regulatory amendments meet regulation drafting principles before submission to DCA and Minister for promulgation. Adhere to submission turnaround times.

Management:
Guide and mentor Enforcement Specialists and Enforcement Coordinator.
Manage and monitor the performance of Enforcement Specialists and Enforcement and Exemptions Administrator.
Constantly train Enforcement Specialists.
Coordinate the implementation of the administration of the fine structure.

Requirements

B Proc or LLB, admitted as an Attorney or Advocate (with pupillage)

Ideal Qualifications LLM:
5 Years experience as an Attorney/Advocate
5 Years experience in interpretation of Statutes,
Admin Law,
Enforcement and
Regulatory environment experience
Post Admission experience 5 Year(s)
