Job Description<\/strong><\/p>\n To facilitate the resolving of labour-related issues in dispute within African Bank Limited in line with Labour-related legislation and regulatory requirements<\/p>\n <\/p>\n Job Requirements<\/strong><\/p>\n PREFERRED MINIMUM EDUCATION<\/p>\n B. Comm. (Law) and\/or LLB Degree 2 years experience post degree in Labour Relations 5 years experience post degree in Labour Relations<\/p>\n <\/p>\n CRITICAL COMPETENCIES<\/p>\n Knowledge of Employment Legislation, (LRA), (BCEA), (OHS) and (EEA)<\/p>\n Drafting Skills<\/p>\n Communications Skills<\/p>\n Negotiation skills<\/p>\n Analytical Skills<\/p>\n Writing Skills<\/p>\n Knowledge and understanding of:<\/p>\n Labour Relations Act<\/p>\n Basic Conditions of Employment Act<\/p>\n Case Law and Jurisprudence<\/p>\n Codes of Good Practices (LRA)<\/p>\n Court rules (RSA)<\/p>\n <\/p>\n Knowledge and understanding of:<\/p>\n OHS Act, 1993<\/p>\n FICA<\/p>\n FAIS<\/p>\n <\/p>\n Technical Writing skills<\/p>\n Knowledge of Labour Relations Act, 1995, as amended<\/p>\n Editing skills<\/p>\n Presentation skills<\/p>\n Training skills Communications skills (verbal and written)<\/span><\/p>\n Negotiation skills<\/p>\n Integrity<\/p>\n Confidentiality<\/p>\n Being pro-active<\/p>\n Impartiality Interpersonal Skills<\/p>\n Coaching and Facilitation Skills<\/p>\n Business Acumen<\/p>\n <\/p>\n KEY RESULT AREAS<\/p>\n Labour Relations Consulting<\/strong><\/p>\n Provide value-add consulting to the business by keeping abreast of all relevant legislation<\/p>\n <\/p>\n Advise management and staff on correct interpretation and application of labour legislation and any amendments<\/p>\n Respond to queries received from employees, management and external parties<\/p>\n Approve employees to be listed on REDS<\/p>\n Engage in collective bargaining process with union\/s<\/p>\n Advise HR on problems experienced regarding garnishees<\/p>\n Update appropriate MIS system <\/p>\n Provide value add litigation services to the business by keeping abreast of all relevant legislation<\/p>\n <\/p>\n Represent the Bank in Labour Disputes and Litigation at the CCMA (Conciliation and Arbitration)<\/p>\n Chair disciplinary enquiries and facilitate grievances<\/p>\n Brief and \/ or assist external counsel on litigious matters where applicable<\/p>\n Facilitate legal process with external practitioners and line managers<\/p>\n Prepare documents and evidence for use in the litigation process<\/p>\n Consult and prepare witnesses for litigation purposes<\/p>\n Advise management in respect of outcome of cases:<\/p>\n Prepare appropriate case reports<\/p>\n Update appropriate MIS system<\/p>\n <\/p>\n Development of Training material and Facilitation\u00a0<\/strong><\/p>\n Revise and update a training module for Chairpersons and initiators training in consultation with direct manager<\/p>\n Conduct the following Training interventions:<\/p>\n Basic labour relations for all managers<\/p>\n Chairing and initiation of disciplinary enquiries for middle and senior management<\/p>\n Interpretation of various pieces of labour legislation to Forensics Department<\/p>\n Day-to-day employee relations to branch managers and supervisors\/team leaders<\/p>\n Update Regional managers quarterly on changes to legislation \/ procedures<\/p>\n <\/p>\n Drafting of Codes, Contracts, Policies and Procedures\u00a0<\/strong><\/p>\n Assess and incorporate best practice within Employee Relations<\/p>\n Draft various service level agreements and related contracts for the Bank for approval as requested<\/p>\n Draft various policies and procedures dealing with day-to-day operational issues within employment relations framework for approval<\/p>\n Implement relevant contracts, policies and procedures<\/p>\n Review relevant contracts, policies and procedures bi-annually<\/p>\n <\/p>\n Legal Compliance Projects\u00a0<\/strong><\/p>\n Interpret Occupational Health & Safety Act, 1993(OHS) Compliance<\/p>\n Advise Management on implementation and requirements of the Act<\/p>\n Monitor and review policies and procedures within the Bank<\/p>\n Identify appropriate training interventions and advise Training and Development accordingly for implementation<\/p>\n <\/p>\n Interpret National Credit Act and advise Management on effect on employee relationship within the Bank<\/p>\n Monitor and review progress for feedback to management.<\/p>\n Facilitate and\/or manage any other labour-related projects within the Bank<\/p>\n <\/p>\n
