To advise the Market Infrastructure and OTC Derivatives providers internally on a wide range of legal issues affecting the industry and allied activities. The person appointed to this position will have a direct reporting line to the Head: Market Infrastructure and OTC Derivative Markets.

 

 

 

 

Job Title: SENIOR MANAGER LEGAL

Job Summary:
Key Performance Areas:
•Assist with the provision of legal advice, interpretations, drafting and opinions to the Department on legislative and regulatory aspects of the financial markets, including proposals for reform of financial markets legislation and drafting of amendments as the need arise;
•Provide input in the assessment of license applications in accordance with the SLC and the protocols in the relevant MoU with the PA and SARB;
•Consider and advise the Department on legal interpretations of the relevant legislation, the ability to suggest changes and improvements to existing legislation and policy is essential;
•Assist the Authority in fulfilling its responsibilities in respect of the International Organisation of Securities Commissions, the G20, the Financial Stability Board and the SADC Committee of Insurance, Securities and Non-banking Financial Authorities and assist Regulatory Liaison department with international liaison between the Authority and other supervisory and regulatory authorities;
•Liaise with and render appropriate regulatory guidance to stakeholders after consultation with
the Manager and Head of Department including representation in relevant meetings of the market infrastructures;
•Identify shortcomings and anomalies to the regulatory framework and subordinate legislation;
•Provide leadership and training to upskill junior members of the legal team;
•Exemplary verbal and written communication skills; and
•The ability to deal confidently and tactfully with senior executives both in the industry and fellow regulators will underpin the success of the candidate.

The candidate should preferably demonstrate the following skills and attributes: strong analytical abilities, attention to detail, active listening, critical thinking, innovative strategic thinking and good understanding of financial markets.

Requirements:
An LLB or similar, with at least 5 years relevant experience preferably in the regulatory environment, within the South African Financial Markets Industry, finance, or related commerce. Solid experience in banking or financial markets is preferred, the ability to monitor corporate governance frameworks including experience in establishing and maintaining professional relationships with internal and external stakeholders and other professionals (auditors and risk specialists), demonstrable experience in reporting on business plans and assessing general performance would be desirable. An admitted Attorney will be an added advantage
